On July 1, 2019, the Governor approved Assembly Bill 97 and Senate Bill 97 which now make Provisional Cannabis Licenses available. An applicant is no longer required to hold or to have held a temporary license to obtain a provisional license.
The Provisional State License can be obtained by showing that your application for a license from any City is either completed OR UNDERWAY. This is very important to the marijuana delivery businesses that are now operating without the required State License.
. With a state license, there can be no search warrants or arrests, the marijuana cannot be confiscated and the landlord is also protected. If you or your employees are currently facing any criminal charges related to the sale of marijuana the Provisional State License will probably help get the criminal charges dismissed. You should consult with your criminal law attorney
